Ecuador Resident Visas

Clouds rise, fragile milk lace, floating dreamlike in the daybreak’s breeze. Fields of green are adorned with apricot rays of early morn spread over razor edged ridge lines and announce the dawn.

Merri and arrived our first time in Ecuador, saw the wonderful dawn and immediately fell in love with this country almost 15 years ago.

There are many benefits, beyond low cost living, of residency in Ecuador.

The first is the sweetness of the people.

Yet we always recommend that you come visit and see for yourself if Ecuador feels right for you. We find that many of our guests love it, but Ecuador is not for everyone.

However if you find you love Ecuador and want to live here full time you’ll need to attain an Ecuador residence visa.

Merri and live less than six months a year in Ecuador. We are not employed in Ecuador. This means that the easiest thing for us to do is use the tourist and other visas.

There is one other set back to Ecuador residence visas. Once your residency visa is approved you can only leave the country 3 months out of the first 18 months. This is a hindrance to us as it is to many.

However many prefer to stay longer and here are some options.

Rules change continually so be sure to check with your travel agent or embassy if you have questions before you travel to Ecuador.

Visa Types

The 9-1 visa is available for retired people who with $800 a month or more of income. (This income is not taxed in Ecuador).

Visa 9-I Retired Persons With income of $800 a month or more

What you need:

• Document of the institution that administers or provides the income. This document should be certified by the pertinent authority in the country of origin and authenticated by the Consul of Ecuador in that county;

• A certificate granted by the Consul of Ecuador in that country that certifies that the person interested in obtaining the visa receives a permanent income of at least U$S 800,00, increasing U$100.00 per every relative that depends of the applicant. Documents that demonstrate this income must be provided.

• Petition signed by the applicant (We provide it)

• “Visa 9-I” Form (We provide it)

• Passport copies including legal staying. (At least 30 days before the legal staying in Ecuador expires). The passport must be valid for at least six months.

• Two pictures (carné size)

• “Datos para cédula” Form (We provide it)

All documents granted in Ecuador must be presented in originals or certified copies.

All documents granted in its country of origin must be authenticated by the Ecuadorian Cónsul and translated to Spanish, if it is the case.

All documents must be presented At least 30 days before the legal staying expires.

(Gary’s Note – Couple’s living together but not legally married must apply separately. A non married partner cannot apply as a dependent).

(If you invest $25,000 in Ecuador real estate or certain types of Ecuadorian investments you can obtain a visa).

Visa 9-II Real Estate Investment or Deposit in Cash, Government Bonds.

• If it is a Real Estate investment, you must present the Purchasing Deed duly registered at Real Estate Registry; and, a Real Estate Registry Certification. (Minimum amount of investment: U$S 25.000, increasing U$S 500 per every relative that depends of the applicant).

• If it is an investment in Certificates of Deposit, a copy of the title or certificate to be deposited in the Central Bank of Ecuador. (Minimum amount of investment: US$25.000, increasing U$S 500 per every relative that depends of the applicant).

• If it is an investment in Government bonds or bonds from other entities of the public sector a copy of the document that certifies the deposit of the bonds in the Central Bank of Ecuador. (Minimum amount of investment: U$S 25.000, increasing U$S 500 per every relative that depends of the applicant).

• Petition signed by the applicant (We provide it)

• “Visa 9-II” Form (We provide it)

• Passport copies including legal staying. (At least 30 days before the legal staying expires)

• Two pictures (carné size)

• “Datos para cédula” Form (We provide it)

All documents granted in Ecuador must be presented in originals or certified copies.

All documents granted in its country of origin must be authenticated by the Ecuadorian Cónsul and translated to Spanish, if it is the case.

All documents must be presented at least 30 days before the legal staying expires.

Visa 9-III, Investment in Industry, Livestock or Exportation.

• If the investment is in Companies (limited companies), Constituted Contract or a document that certifies the increase of the capital of the company registered at the Register Mercantile Office. The document must include a clause containing the commitment established in the Regulation of the Foreign Affair Law, Article 32, numeral VII. (Minimum amount of investment: U$S 30.000).

• If the investment is in a Personal Busines, the applicant must present Registration by the Chamber of Commerce. Registro Unico de Contribuyentes. An authorization from the Government to allow companies to act as tax collector (RUC) Authorization from the Ministry of Industry.The commitment established in the Regulation of Foreign Affairs Law, Article 32, numeral VI. . (Minimum amount of investment: U$S 30.000,oo).

• If the Investment is in Agriculture and/or Livestock, Authorization from the Ministry of Industry, Commerce and Fisheries Registro Unico de Contribuyentes. An authorization from the Government to allow companies to act as tax collector (RUC). Titles of ownership registered and all taxes paid; Registration by Chamber of Commerce or Industry (whichever is related) . (Minimum amount of investment: U$S 30.000).

• Petition signed by the applicant (We provide it)

• “Visa 9-III” Form (We provide it)

• Passport copies including legal staying. (At least 30 days before the legal staying expires)

• Two pictures (carné size)

• “Datos para cédula” Form (We provide it)

All documents granted in its country of origin must be authenticated by the Ecuadorian Cónsul and translated to Spanish, if it is the case.

All documents must be presented at least 30 days before the legal staying expires.

Visa 9-IV Representatives, Agents and others.

A: CONTRACT OF EMPLOYMENT WITH A NATURAL PERSON OR WITH A COMPANY: Contract of employment for an indefinite time. Contract authorized by the Director of Human Resources of the Ministry of Labour (Dirección de Recursos Humanos del Ministerio de Trabajo).

B: LEGAL REPRESENTATIVE: Provided by a Company, established in Ecuador: General Power of Attorney for the administration of the company or legal/judicial representation, authorized by the General Board of the company; Appointment as legal representative of the company; Dee of the constitution of the company or the increase of capital, duly registered; Certificate of having completed legal obligations given by Superintendent of Companies or Superintendent of Banks.

C: MEMBER OF ORGANIZARIOS AND RELIGIOUS GROUPS RELATED TO THE MODUS VIVENDI WITH THE HOLLY SEE: Certificate from the legal representative acknowledging that the foreigner is part of the organizations or part of a Catholic Religious Group, as well as the name of the position the person will be in charge in Ecuador; Appointment of the legal representative duly registered.

D: JOURNALISTS: Certificate from the Public Secretary for Communication acknowledging that the applicant is a foreign journalist duly accredited.

• “Visa 9-IV” Form (We provide it)

• Passport copies including legal staying. (At least 30 days before the legal staying expires)

• Two pictures (carné size)

• “Datos para cédula” Form (We provide it)

9-V Professionals

• University or superior education degree, recognized and ratified by Ecuadorian University and registered by CONESUP (Government Institution that controls all the Universities)

• In the case that the applicant is under an agreement, copy of the agreement duly registered will be needed.

• Petition signed by the employer (We provide it)

• “Visa 9-V” Form (We provide it)

• Passport copies including legal staying. (At least 30 days before the legal staying expires)

• Two pictures (carné size)

• “Datos para cédula” Form (We provide it)

Visa 9-VI Protection: Under the protection of the spouse, parents, grandparents or siblings

• Certificate of marriage or birth certificate, considering the case.

• Certificate showing the economic solvency of the person who presents the plea that certifies the subsistence of the beneficiary in Ecuador.

• Copy of the identity card of the person who presents the plea and vote certificate if the applicant is Ecuadorian citizen.

• Copy of the passport of the person who presents the plea, if the person is a foreigner as well as copy of the passport of the beneficiary.

• Petition signed by the person who presents the plea (We provide it)

• “Visa 9-VI” Form (We provide it)

• Passport copies including legal staying. (At least 30 days before the legal staying expires)

• Two pictures (carné size)

• “Datos para cédula” Form (We provide it)

An Ecuador visa attorney sent me this note in March 2011.

Dear Gary,  Due to the different problems with the visas the government has decided to unify all visas immigrant and non immigrant under the Minister of Foreign Affairs.

Previously resident visas were always approved by the Minister of Government.

The Minister of Government for some more months will still be receiving applications for the resident or immigrant visas.

Nevertheless, the only one authorized to approve any kind of visa is the Minister of Foreign Affairs.

As a consequence, everything is going slower again for the next months. Once the Minister of Foreign Affairs has completely integrated the methodology to process inmigrant or resident visas we believe it will be for better. Regards.
